Thank you for your continued interest in Sony products. As we announced on April 27, 2007, Sony discovered the following symptom with regard to Picture Package Ver. 1.8, the bundled software with its certain DVD "Handycam" Camcorders launched in 2005 and 2006 as listed below. When a customer tries to shut down his/her personal computer with certain OS as listed below, in which Picture Package Ver.1.8 is installed, it restarts unexpectedly and the customer can not shut down it. This symptom is attributable to a mismatch between certain application software of which setting has recently been changed, and "Sony DVD Handycam USB driver 2", a USB driver component of Picture Package Ver.1.8. (Any other issue with regard to Picture Package Ver.1.8 has not been reported to Sony at this moment.) In order to address the aforementioned symptom, Sony has released the update version of "Sony DVD Handycam USB Driver 2" which is available to you in the following procedure. Then the download of the software will start. Save the file titled as [dd_update0705a.exe(270KB)] to the desktop of your computer. IMPORTANT: YOU SHOULD CAREFULLY READ THE FOLLOWING END-USER LICENSE AGREEMENT BEFORE USING THE SOFTWARE "USB Device Driver" DEVELOPED BY SONY (THE "SOFTWARE"). END USER LICENSE AGREEMENT This End-User License Agreement ("Agreement") is a legal agreement between you and Sony Corporation ("SONY"), the licensor of the SOFTWARE. By pushing an "AGREE" button hereinbelow, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, you may not install, copy or use the SOFTWARE. Article 1. SOFTWARE LICENSE The SOFTWARE is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE is licensed, not sold. Article 2. GRANT OF LICENSE SONY grants you a non-exclusive license, without the right to sublicense, to personally install the SOFTWARE in your personal computer and use the SOFTWARE for the purpose of connecting such your personal computer with, and transferring the data to and/or from, Sony's digital still camera and/or camcorder ("SONY'S PRODUCT"). Article 3. RESTRICTIONS AND LIMITATIONS The license granted hereunder shall be subject to the following restrictions and limitations except as expressly permitted by applicable legislation: 1) You may not install and use the SOFTWARE or any copy thereof on more than one (1) personal computer; 2) You may not distribute the SOFTWARE to other personal computers over any information network (expressly including the Internet and an internal network such as LAN); 3) You may not sell, rent or lease the SOFTWARE to any third party; 4) You may not modify, reverse engineer, decompile or disassemble the SOFTWARE in whole or in part; 5) You may not copy or reproduce any or all portion of the SOFTWARE (except for one (1) copy for backup purpose); 6) The SOFTWARE is licensed as a single product. Its component parts may not be separated for use on more than one (1) personal computer; and 7) You may transfer all of your rights under this Agreement only as a part of the sale or transfer of the SONY'S PRODUCT, provided that you transfer all of the SOFTWARE (including all copies and component parts), retain no copy of the SOFTWARE, and the successor agrees to be bound by the terms of this Agreement. Article 4. COPYRIGHTS All title to and copyrights on the SOFTWARE and any copies of the SOFTWARE are owned and controlled by SONY. All rights not specifically granted under this Agreement are reserved by SONY. Article 5. DISCLAIMER You expressly acknowledge and agree that use of the SOFTWARE is at your sole risk. THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, AND SONY EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SONY DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS, OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR CORRECT. FURTHERMORE, SONY DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SOFTWARE IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY SONY OR A SONY AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE SOFTWARE PROVE DEFECTIVE, YOU (AND NOT SONY OR A SONY AUTHORIZED REPRESENTATIVE) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. Article 6. LIMITATION OF LIABILITY SONY SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGES, EITHER DIRECT, INCIDENTAL, CONSEQUENTIAL OR OTHERWISE, FOR BREACH OF CONTRACT, BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL THEORY RELATED TO THE SOFTWARE. SUCH LOSS AND DAMAGES INCLUDE, BUT ARE NOT LIMITED TO, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF USE OF PRODUCT OR ANY ASSOCIATED EQUIPMENT, DOWN TIME AND USER'S TIME, EVEN IF SONY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS AND DAMAGES. IN ANY CASE, SONY'S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID ALLOCABLE TO THE SOFTWARE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF DIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU. Article 7. DAMAGES ARISING OUT YOUR ACTIONS You shall defend and hold SONY harmless from against all liabilities, demands, damages, costs, expense and losses arising out of the use of the SOFTWARE and/or breach of any of the provisions of this Agreement by you. Article 8. COMPLIANCE WITH LAWS You agree to comply with all applicable copyright protection laws in connection with your use of the SOFTWARE. In addition to the terms provided for in this Agreement, SONY may take appropriate measures to protect copyright of the SOFTWARE. Article 9. TERMINATION 9.1 You may terminate this Agreement at any time by stop using the SOFTWARE. 9.2 Without prejudice to any other rights, SONY may terminate this Agreement at any time if you fail to comply with the terms and conditions of this Agreement. 9.3 In case of termination of this Agreement, you must remove all copies of the SOFTWARE from your personal computer product within two weeks of such termination, and if requested by SONY, submit to SONY a proof of removal thereof. 9.4 The provisions of Articles 4 through 12 of this Agreement shall survive the termination of this Agreement. Article 10. SEVERABILITY If any part of this Agreement is held invalid or unenforceable, the other parts will remain valid to the extent as permissible by law. Article 11. GOVERNING LAW 11.1. This Agreement shall be construed, governed, interpreted and applied in accordance with the laws of Japan. 11.2. YOU WAIVE ALL RIGHTS AND/OR ENTITLEMENT TO TRIAL BY JURY IN CONNECTION WITH ANY DISPUTE THAT ARISES OUT OF OR RELATES IN ANY WAY TO THIS AGREEMENT. Article 12. GENERAL This Agreement shall be binding upon the parties' authorized successor and assignees. Neither party's waiver of any breach of failure to enforce any of the provisions of this Agreement at any time shall in any way affect, limit or waive such party's right thereafter to enforce and compel strict compliance with every other provision. When the message "The driver file will be replaced with a new version." appears on the computer screen, click [OK]. When the message "The replacement of the file is completed." appears, the update is completed. Restart your computer. Note for the customers who removed "Sony DVD Handycam USB Driver 2" in accordance with the temporally measure explained in the April 27, 2007 announcement. Please reinstall Picture Package Ver. 1.8, bundled software with DVD "Handycam" camcorder prior to the update ("Sony DVD Handycam USB Driver 2" will be installed automatically.). Then, please proceed with the download and the update procedure above.
